Request for Voluntary retirement from persons suffering from disability — Supreme Court Order in Bhagwan Dass & Anr Vs Punjab State Electricity Board, (2008) 1 SCC 579

Subject: Request for Voluntary retirement from persons suffering from disability — Supreme Court Order in Bhagwan Dass & Anr Vs Punjab State Electricity Board, (2008) 1 SCC 579.

The undersigned is directed say that vide Department of Personnel and Training’s OM No.18017/1/2014-Estt(L) dated the 25 th February, 2015, certain clarifications regarding treatment of leave and absence of disabled Government servants have been issued.

2. Instances have come to notice where Government servants apply for voluntary retirement under various provisions like Rules 38, Rule 48 and 48A of CCS (Pension) Rules, 1972 or Rule 56 of the Fundamental Rule on account of hardships faced by them due to a disability, as they are unaware of the protection provided by the Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of justifys and Full Participation) Act, 1995 (PWD Act). Section 47 of the PwD Act, 1995 is reproduced below for reference:

“Non-discrimination in Government Employment — (1) No establishment shall dispense with, or reduce in rank, an employee who acquires a disability during his service.

Provided that, if an employee, after acquiring disability is not suitable for the post he was holding, could be shifted to some other post with the same pay scale and service benefits;

Provided further that if it is not possible to adjust the employee against any post, he may be kept on a supernumerary post until a suitable post is available or he attains the age of superannuation, whichever is earlier. No promotion shall be denied to a person merely on the ground of his disability;

Provided that the appropriate Government may, having regard to the type of work carried on in any establishment, by notification and subject to such conditions, if any, as may be specified in such notification, exempt any establishment from the provisions of this section”.

3. The issue had come up in Bhagwan Dass & Anr Vs Punjab State Electricity Board (2008) 1 SCC 579, decided by the Hon’ble Supreme Court where the employee who had during his service suffered from blindness, had applied for voluntary retirement. The Hon’ble Supreme court has observed that the Petitioner was not aware of any protection that the law afforded him and apparently believed that the blindness would cause him to lose his job, which was the source of livelihood of his family. In those circumstances, it was the duty of the superior officers to explain to him the correct legal position and to tell him about his legal justifys.

4. Keeping in view the provisions of the Section 47 of the PwD Act, 1995 and the above mentioned judgement, it has been decided that whenever a Government servant seeks voluntary retirement citing medical grounds, or when the said notice has been submitted due to a disability, the administrative authorities shall examine as to whether the case is covered under Section 47 of PWD Act, 1995. In case the provisions are applicable, the Government servant shall be advised that he/she has the option of continuing in service with the same pay scale and service benefits.

5. In case a disabled Government servant reconsiders his decision and withdraws the notice for voluntary retirement, his case shall be dealt with under the provisions of the Section 47 read with the Department of Personnel and Training OM dated 25th February, 2015, mentioned above. If however, in spite of being so advised, such Government servant still wishes to take voluntary retirement, the request may be processed as per the applicable rule.

6. All the Ministries and Departments are requested to keep the above in view while processing cases of requests for Voluntary retirement from disabled Government servants.

Bihar government announces pre-election for government employees and pensioners by hiking Dearness Allowance by 6% to 11%

Nitish Kumar government announces pre-election bonanza, hikes DA for employees, pensioners.

Patna: The Nitish Kumar government in Bihar today announced a pre-election sop for government employees and pensioners by hiking Dearness Allowance by six to 11 per cent.

A decision to this effect was taken at a meeting of the state Cabinet presided over by Chief Minister Nitish Kumar.

Briefing on the cabinet decisions, Principal Secretary, Cabinet Coordination, Shishir Sinha told reporters the DA has been increased from 107 per cent to 113 per cent for revised salary category for employees.

For those falling under unrevised category (those who could not avail 6th Pay Commission because of some service related dispute) the DA was raised from 212 per cent to 223 per cent, Sinha said.

For both categories, which constitute about four lakh employees, the hiked DA would be applicable with effect from January 1 this year, the principal secretary said.

The government would incur an additional financial burden of Rs 821 crore annually due to hike in the DA, he added.

The Bihar cabinet also approved a total of 24 agendas of different departments today.

‘Narendra Modi may announce one-rank one-pension later this month’

Prime Minister Narendra Modi is likely to make an announcement later this month on ex-servicemen’s long-pending demand of one-rank one-pension.

Rao Inderjit Singh, Minister of State for Defence on Tuesday told media persons that since coming to power in May last year the National Democratic Alliance consulted all stakeholders on the issue and then arrived at a decision.

“We came to power in May last year. Over the past one year we have consulted political parties, all stakeholders on one-rank one-pension, whether they are servicemen or ex-servicemen ,” he said.

CORRIGENDUM
l. The following amendments are made to this Ministry’s letter No. B/68628/Q3(Bl/2450/D(Q&C) dated 27.05.1988 and as amended from time to time with last corrigendum No. B/68628/Policy (Qtr)/555/D(Q&C)/07 dated 22 May 2007 regarding charging of damages for unauthorised occupation of defence pool accommodation and recovery of licence fee when defence pool accommodation is allotted to ineligible persons/ organization/ private parties. The existing entries against para 2a, 3 and 5 may be deleted and substituted as follows:-

(a) For : PARA 2(a)READ 
(a) Delhi/New Delhi- The damages rates for unauthorised occupation of Defence Pool accn for Delhi and New Delhi shall be 40 times Licence Fee amt applicable to service personnel per month in respect of Type ‘A’ to ‘D’ (Type I to IV) accommodation, 50 times Licence Fee applicable to service personnel per month in respect of Type 'E’ and ‘F‘(Type V & VI) and 55 times Licence Fee applicable to service personnel per month in respect of type 'G' to 'H' (Type VII & VIII). in addition, garden and other charges, as applicable shall also be recovered.

(b) FOR : PARA 3READ 
(a) So far as para 2 (a) is concerned these orders will be effective from 15 Jan 2018 and will remain in force till further orders. The rates revised under para 2 (b) & 2(c) would be effective from the date of promulgation of revised rates by the respective local CPWD &MES authorities as the case may be.

(c) FOR : PARA 5READ
The rates of damage as above would be the rates to be charged from unauthorised occupants. These rates would be effective from the dates mentioned in para 3 above and all pending cases prior to the above period may be disposed of based on the pre-revised orders.  Unauthorised occupation beginning from the date of effect of the revised orders or a subsequent date would come within the purview of revised rates of damage.

This issues with the concurrence of Ministry of Defence (Finance/Works-III) vide their ID No 66/F/W-III dated 06 Apr 2015.

Along with the decreasing percentage of additional Dearness Allowance, there is also a noticeable fall in interest among employees to know more about ‘Expected DA’…!

“There was tremendous curiosity when initial reports surfaced that ‘Expected DA’ could be as high as 10% in 2013. But, now, when the expectation is fixed at around 5%, readership for the topic has decreased considerably.”

Dearness Allowance for Central Government employees, which is given once every six months, is currently expected to be not more than a very minimal 5%.

Additional Dearness Allowance from July 2015 is based on the fluctuation in price of essential commodities between the months of January and June 2015. With the CPI(IW) data available for only three months as of now, the general prediction is that if the AICPIN falls by 6 points total in three months, the additional DA could be as low as 4% from July 2015.

The chances of a 6% of additional DA increase with effect from July 2015 are very minimal.

Statistics of AICPIN of the next two months will decide if the next additional DA is going to be 5% or 6%.
Why is Dearness Allowance, which is given once every six months in order to help the salaried class manage the increasing prices of essential commodities, so important this time?
