OFFICE MEMORANDUM
Subject :- Rates of Dearness Allowance applicable w.e.f. 1.1.2013 to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised scale as per 5th CPC.

The undersigned is directed to refer to this Department’s O.M. of even No. dated 15th October, 2012 revising the Dearness Allowance w.e.f. 1.7.2012 in respect of employees of Central Government and Central Autonomous Bodies who continue to draw their pay and allowances in the pre-revised scales of pay as per 5th Central Pay Commission.

2. The rates of Dearness Allowance admissible to the above categories of employees of Central Government and Central Autonomous bodies shall been enhanced from the existing rate of 151% to 166% w.e.f. 1.1.2013. All other conditions as laid down in the O.M. of even number dated 3rd October 2008 will continue to apply.

3. The contents of this Office Memorandum may also be brought to the notice of the organizations under the administrative control of the Ministries / Departments which have adopted the Central Government scales of pay.

Subject: Stepping up of pay of Assistant Accounts Officers of Defence Accounts Department at par with directly recruited SAS Apprentices.
 
The matter regarding stepping up of pay of promotee AAOs/SO(A)s at par with directly recruited SAS Apprentice to mitigate the pay anomaly arisen due to grant of higher entry pay to direct recruits was referred to Ministry of Defence(Finance).
 
2. In response, directions/clarification issued by Ministry of Finance, Deptt. of Expenditure vide UO FTS No. 169937/12 dated 12.02.2013 and Department of Personnel and Training U. Diary No. 63498/2012-Pay-I dated 28.8.2012 received under Ministry of Defence(Finance) ID Note No.1891/C/12 dated 13.02.2013 is attached for your information, guidance and necessary action please.

No. 63498/2012-Pay-I dated & 28.08.2012 and UO FTS No.169937/12 dated 12.02.2013 of Ministry of Finance, Department of Expenditure, issuing the necessary clarification, is enclosed herewith for further action of the Department.

2. The proposal of the Ministry of Defence regarding stepping up of pay of AAOs of DAD at par with directly recruited SAS Apprentices has been examined in this Delartment. It is clarified that as SAS Apprentices are placed in the common seniority list of AAOs below them. The criteria set out in  the Department of Expenditure U.O. Note dated 22.10.2010 (Page7/cor.) appear to be satisfied for stepping up of the pay of promotees with reference to DRs.

The proposal of MOD regarding stepping up of pay of Assistant Accounts Officers of Defence Accounts Department at par with directly recruited SAS Apprentices has been further examined in the Department of Expenditure. This Department agrees to the stepping up of pay of the promotee AAOs at par with the directly recruited SAS Apprentices subject to the following conditions : - 
 
(a) Stepping up of the pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the pay of the directly recruited junior provided they belong to the same seniority list for all purposes.
 
 
(b) Govt. servants cannot claim stepping up of their revised basic pay with reference to entry pay in the revised structure for direct recruits appointed on or after 1.1.2006, as laid down in Section II of Part A of the First Schedule to the CCS(RP) Rules, 2008. if their cadre does not have an element of direct recruit br in cases where no junior is drawing basic pay higher than them.
 
(c) Stepping up of pay of the seniors shall not be applicable in cases where direct recruits have been granted advance increments at the time of recruitment.

However, the employees who cross the age of 59 years shall be allowed to avail one All India LTC during the last year of their retirement.
 
Other terms & conditions of the above letter dated 05.09.2011 will remain unchanged.

Defects in Dwelling Units Constructed by CGEWHO

Certain allottees of the scheme have made allegations regarding dwelling units constructed by Central Government Employees Welfare Housing Organization (CGEWHO) inter-alia regarding poor quality, incompetency, mismanagement, misappropriation of funds and delay in completing the project. This was stated by Shri Ajay Maken, Union Minister of Housing & Urban Poverty Alleviation (HUPA), in the Lok Sabha today, in a written reply to a question by Shri N.S.V Chitthan, Shri Sanjay Bhoi & Shri A. Ganeshamurthi.

The Minister further stated that Government had issued directions to CGEWHO to get a third party post construction quality audit done. Accordingly CGEWHO had engaged Housing & Urban Development Corporation (HUDCO) for post construction quality audit. The report submitted by HUDCO points out some non-rectifiable defects as well as some rectifiable defects in construction. Based on this report, CGEWHO has been asked to take measures to rectify the rectifiable defects and make financial recovery from the contractor for non-rectifiable defectsin terms of the agreement.

The Minister further stated that the matter is being further investigated and anybody found guilty will not be spared, the Minister added.

The Unani unit at Daryaganj, New Delhi is functioning without any pharmacist on Tuesdays for the last three years under an arrangement in which the pharmacist is deputed to visit the CGHS Medical Centre, Parliament House Annexe weekly on Tuesday to provide his services there in the Unani system of medicine.

Action has been initiated to fill up the vacant posts of Pharmacists (Unani) under CGHS at Delhi. No Objection Certificate (NOC) has also been received from the Department of Personnel and Training in this regard.

This information was given by Union Minister of Health & Family Welfare ShriGhulamNabi Azadin written reply to a question in the RajyaSabha yesterday.

Sub : Enhancement in the rate of Risk Allowance in respect of eligible unskilled staff on the railways in accordance with DOP&T's guidelines.
 
Ref : Railway Board' letter No.E(P&A)I-84/SP-1/TP-1 dated 21.08.1991.
 
It has been decided to enhance the rate of Risk Allowance in respect of eligible unskilled workers on the railways/Production Units as per list attached.
 
2. The V CPC had recommended that Risk Allowance should be admissible to only those staff who face continuous risk rather than contingent risk while performing their duties. As such in accordnace with these guidelines, the categories/staff engaged in the jobs as mentioned in the list annexed with this letter were identified as eligible for grant of Risk Allowance. The rate of Risk Allowance in respect of these categories/staff is enhanced from the existing rate of Rs.20 per month to Rs.40 per month w.e.f. 01.09.2008 to 31.12.2010.
 
3. The rate of the Risk Allowance would increase by 25% every time the Dearness Allowance payable on revised pay scales goes up by 50%.
 
4. Subsequent to enhancement in the rate of Dearness Allowance to 51%, the rate of Risk Allowance would be Rs.50 per month from 1.1.2011 onwards.
 
5. The categories who are in receipt of HPCA/PCA are not eligible for grant of Risk Allowance.
 
6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

2. Those directly engaged in galvanising tanks, effluent treatment plant, manufacturing of insulation components involving hazardous chemicals etc.
3. Those directly engaged in use of electrolytes.
4. Those directly exposed to metallic dust, fumes generated from resin bakers, smoke from the furnance, carbon burst shops.
5. Those directly working in Melting Shop in all foundaries where scrap is used.
6. Moulding shop in Rail Wheel Factory / Bangalore.
7. Those directly engaged in chrome plating.
8. Safaiwalas directly working in underground drains/sewer pipes, cleaing of manholes.
9. Safaivalas directly working in sewerage treatment plant in workshops.
10. Malaria Khalasis directly engaged in spraying pesticides, handling acids, anti-larval drugs, etc.

Subject: Non-relieving of Section Officers covered under RTP - regarding.

The undersigned is directed to refer to this Department OMs of even number dated 06.02.2013, 15.03.2013 and 12.04.2013 vide which all the Cadre Units were requested to relieve the officers covered under RTP orders dated 21.12.2012 and 09.01.2013. As per the records available in this office, a number of Section Officers included in the said orders have not been relieved by the Cadre Units concerned as yet.

2. Non-compliance of RTP orders by various Cadre Units has led to various administrative difficulties for DOP&T in smooth cadre management DOP&T is well aware of the fact that large number of vacancies exists across the 42 Cadre Units. UPSC had conducted the Limited Departmental Competitive Examination (LDCE) for Section Officer grade for 2009, 2010 & 2011 and the result of the written part of the examination has already been declared. After declaration of the final results by UPSC, which is expected shortly, almost all the vacancies in Section Officers’ grade across Cadre Units of CSS would be filled up.

3. This is a transitional phase and the Cadre Units are requested to cooperate with DOP&T during this phase. It is, therefore once again requested that all the offìcers, who have not yet been relieved, may be relieved immediately.
