INTERNATIONAL WOMEN'S DAY – 08.03.2013

Dear Comrades,

                The International Women' day which falls on 8th March is observed throughout the world. The UN theme for the International women's day 2013 is "A promise is a promise; time for action to end violence against women". This year in India, we saw a massive uprising against the atrocities on women immediately after the barbarous sexual assault on student in Delhi.  She later succumbed to the injuries suffered during the assault.

Thousands of young men and women, students and common people assembled at Vijay Chowk and elsewhere in Delhi and other parts of the country demanding stringent action against the culprits besides asking the Government to make enactment to protect the women. Empowerment of women is an issue that has to be focused and taken to its logical end. There is no shortcut for that. Raising the conscious level of the society at large through sustained campaign and struggles is the only way out. It is a painstaking path, but there is no other alternative.

The brutalities against women, attempt to dispossess the women of their right to property is the outcome of the patriarchal system that has taken roots in our country. In our society today women are being portrayed as a commercial commodity an offshoot of the impact of the neo liberal economic policies where except profit nothing matters. The fight for empowerment of women, hence, cannot be separate from the struggle against finance capital driven neo-liberal economic policies.

We call upon  every affiliate and the State Committee to observe the International Women's Day in a befitting manner by holding Seminar, Convention, meetings etc depending upon the local situation. The programmes may be utilized to drive the theme of the International Women's Day 2013. The apathy of the rulers towards crime against women must be exposed.  We must bring to the public gaze that many in the ruling class have criminal background and are facing charges of assault on women. The convention/seminar/meeting may be preceded by handbills focusing on this issue.

Sub:-Grant of Financial upgradation under MACPS to the employees holding feeder post in a cadre where promotional post is in same Grade Pay.

The undersigned is directed to refer to NFIR’s letter No. IV/MACPS/09/Pt-6, dated 31/01/2013 and to state that the provisions contained in Para-1 of Annexure to Board’s letter dt.10-06-09 may be read alongwith the provision contained in Para-8 of Annexure to said letter dated 10-06-09 which stipulates that promotions earned in the Post carrying same Grade Pay in the promotional hierarchy as per Recruitment Rules shall be counted for the purpose of MACP Scheme.

It is further stated that on receipt of references from Zonal Railways seeking clarification as to what Grade Pay would be admissible under MACPS to an employee holding feeder post In a cadre where promotional post is in the same Grade pay, a reference was made to DoP&T seeking their clarificaticn. Based on the clarifications given by DOP&T, Board’s letter dated 13-12-2012 has been issued Since DoP&T is nod al department, of Govt. on the subject of MACPS, this Ministry is not in position to deviate from the instructions/clarifications issued by them.

In view of the above, Federations is requested may please appreciate the position.

Subject:-Grant of dual (two) family pension from military as well as Civil employment.

Consequent upon issue of GOI,MOD No. 01(05)/2010-D(pen/Pol) dated 17.01.2013 (copy enclosed as Annexure) family of Armed forces officers who got reemployed in Civil Dept/PSUs/ Autonomous bodies/ Local funds of central/state Govt. after getting retired from military service and were in receipt of military pension till death , shall be allowed to draw family pension from military service in addition to the family pension, if any authorized from the reemployed civil Dept. subject to fulfillment of other prescribed conditions as hither to fore.

The provision of above letter are applicable to the Armed Forces Personnel who got discharged/retired/invalided out from service w.e.f. 24.09.2012 or thereafter. Benefit of this provision has also been allowed in past cases. However the financial benefits shall be granted from 24.09.2012 only.

It is therefore requested to please identity the affected cases and forward claim on prescribed form through concerned service Hqrs. to pension sanctioning authority alongwith following documents /information.

1. NOK and family details from service Head quarters

2. A certificate regarding grant/non grant of family pension from re­employed along with family details or details of grant of family pension for civil service with the following details.

  •     Name and address of Civil Deptt./PSUs/Autonomous bodies where officer was re-employed for second employed after discharge from military service.
  •     Death certificate of officer
  •     PDA details alongwith A/c No.
  •     BSR Code of Paying Branch
  •     PPO No. notifying family pension for civil service and name and address of PPO issuing Authority. A copy of PPO should also be enclosed.

3. PPO No under which retiring pension was granted from defence side.

4. Current PDA details alongwith A/c No from where pension now desired.

5. Last payment certificate by PDA in respect of ordinary family pension from military service indicating date upto which family pension was paid to, if pension was sanctioned, name of family pensioner, date of stoppage of family pension, PPO No. notifying family pension must be clearly mentioned.

6. This circular has been uploaded on this office website www.pcdapension.nic.in for dissemination across the all concerned.

(a)whether there is a proposal to provide fixed minimum pension to all the employees who are covered under Employees” Provident Fund Organisation (EPFO);

(b)if so, the details thereof alongwith the minimum amount Government is planning to give to the pensioners;

(c)whether Government has decided to revise the existing scheme in view of demand of workers for a reasonable hike in their EPF pension;

(d)if so, by when the enhanced pension is likely to be disbursed; and

(e)the number of employees who are getting pension benefits from EPFO at present?

ANSWER

(a) to (d):     A proposal to enhance minimum pension to Rs.1,000/- per month under Employees’ Pension Scheme, 1995 is under consideration of the Government. However, no time frame for implementation of the proposal can be given.

(e):     At present, 41 lakh pensioners are getting pension benefits from EPFO.

Subject: Admissibility of arrear in 5th CPC for PW Profit and Incentive after Re-Structuring of Cadre on 6th CPC recommendation.

One of our Branch AOs has raised a question as to whether arrear of Piece Work Profit is to be paid alongwith pay arrears as accrued due to implementation of the restructuring of Artisan Cadre with retrospective effect.

This office has examined the matter and as the restructuring w.e.f. 01/01/2006 has resulted in promotional movement of Industrial Employees guided under Factories Act hence they became entitled for Piece Work Earnings at enhanced rate as per minimum of the higher pre-revised Pay Scales corresponding to the revised pay scales in which their pay has been fixed as a consequence on such restructuring. As such, they have also become entitled for resultant Piece Work Arrears and payments may be released accordingly.

In this connection it is requested to please intimate no. of affected individuals whom the resultant piece work arrears to be paid with approximate budgetary implications for such payments.
