Dear Sirs,

Dearness Allowance for Workmen and Officer Employees in banks for the months of February, March & April 2013 under IX BPS/Joint Note dt. 27.4.2010.

The confirmed All India Average Consumer Price Index Numbers tor Industrial Workers (Base 1960—100) for the quarter ended December 2012 are as follows :-
October 2012 – 4953.22
November 2012 – 4976.05
December 2012 – 4998.87

Consequently, dearness allowance to employees is payable for 535 slabs for the period February, March & April 2013 i.e. an increase of 25 slabs over the current level.

In terms of clause 7 of the 9th Bipartite Settlement dated 27.04.2010 and clause 3 of the joint Note dated 27.04.2010, the rate of dearness allowance payable to workmen and officer employees for the months of February, March & April 2013 shall be 80.25 % of ‘pay’. While arriving at dearness allowance payable, decimals from third place may please be ignored.

We advise banks to pay the difference between the old and revised salary and allowances to officers on an ad hoc basis. pending amendments to Officers Service Regulations.

A meeting of the representatives of the three Federations viz. AIDEF, INDWF and BPMS took place at Kolkatta on 12/12/12, to discuss about the framing of Charter of Demands and also to formulate various action programmes for jointly organizing the general strike on 20 and 21 of February, 2013 in the Defence Establishments The following were present.

The meeting took a serious note of the attitude of the Government of India in not settling the various outstanding demands of the Defence Civilian Employees pending at various levels in the Government. The efforts taken by the federations to settle all those issues through negotiation and discussion has not yielded an result.

The meeting also expressed its concerned about the ongoing privatization, outsourcing and contractualisation in the Defence Establishments and also the privatization policy adopted through DPP-2011 and allowing FDI in Defence Research and Production etc. The meeting also discussed about the declaration adopted by the Central Trade Unions in the National Convention of Workers held at New Delhi on th 04th of September, 2012. After considering all the above aspects it has been unanimously decided to observe 2 days strike of Defence Civilian Employees on the 20th and 2l of February, 2013.

The meeting also formulated the enclosed 46 Charter of Demands and also the action programme for jointly organizing the strike successfully. The meeting has also decided to constitute a National Level Joint Action Committee consisting of the following representatives of the three Federations.

DRAFT CHARTER OF DEMAND
Common Demands of Defence Civilian Employees

1) Stop privatization of Def. Production and in all related activities like Research & Development, services and maintenance etc.
2) Stop all types of outsourcing and contract in the Defence Establishments.
3) No FDI in Def. Production and Research.
4) Regularize all Contract, Casual & Daily wage workers, who are engaged in permanent and perennial jobs and Payment of Wages at the same rate as available to the regular workers of the Industry / Establishment.
5) Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs. 10,000/- linked with cost price index.
6) Remove all ceilings on payment and eligibility of Bonus, Provident Fund and increase the quantum of gratuity.
7) Compulsory registration of Trade Union within a period of 45 days and immediately ratification of the 110 Conventions Nos. 87&98.
8) Fill up all posts lying vacant in the Defence Establishments and restore all posts abolished between 2001 and 2009 in the name of ADRP.
9) Promotional opportunities of all categories of employees may be enhanced by Cadre Restructuring in consultation with the Federations.
10) Scrap the New Pension Scheme, withdraw the PFRDA bill and ensure Pension for all.
11) Liberalize the Compassionate Appointment scheme by removing the artificial 5% restriction and grant Compassionate Appointment 100% as being done in the case of Railways.
12) Immediate merger of 50% DA with Basic Pay for all purposes.
13) Immediate wage revision of the Central Government Employees by setting up the 7th Central Pay Commission.
14) Remove the artificial restriction of 40 days PLB for AOC, Navy, Air Force, EME & Ordnance Factories, The PLB should not be less than the Adhoc Bonus of 30 days.
15) Merger of HS Gr-I1 and Gr-I in the Grade Pay of Rs.2800/- in PB-i. Alternatively the movement from HS Gr-II to Gr-I should be ignored for the purpose of ACP/MACP.
16) Inclusion of more risk prone operations and left out organizations for payment of Risk Allowance.
17) Revision of Night Duty Allowance in 5th & 6th CPC pay scales and remove the artificial eligibility ceiling for NDA by implementing the Arbitration Award and also the recent judgment of the Hon’ble Supreme Court.
18) Settle all 6th CPC Anomalies including the grant of MACP in the promotion hierarchy and other Pending anomalies.
19) Grant of Night Duty Allowance to the Chowkidar of all Defence Establishments at par with the Durwans of Ordnance Factories.
20) The regularized casual/adhoc service may be counted for the purpose of ACP/MACP benefits by implementing the Supreme Court Judgment which is implemented for a section of the Naval Employees.
21) Trained Trade Apprentices of Defence Establishments may be given employment guarantee and pending the same the trained trade apprentices should not be subjected to written test.
22) Computation of overtime wages under the Factories Act by including all allowances like HRA, Transport Allowance, Small Family Allowance etc. as provided in Section 59 of the Factories Act.
23) Trade Union rights may be given to all the Defence Civilian Employees up to Chargeman category and also for employees working in Military Hospitals, Training Centres, Station Hqrs, & SRO-17E Areas
24) CSD Canteen facilities may be provided to the retired Defence Civilian Employees.
25) Revision of the Fixed Medial Allowance and also eligibility of reimbursement of Medical Expenditure to Employees getting FMA as directed by the Hon’ble High Court of Punjab and Haryana.
26) Immediate payment of Over Time Arrears w.e.f. 01.01.2006 to DRDO Employees and payment of Revised OT for the Chargeman Category of Navy.

Ordnance Factories Specific Issues

27) Payment of Time Wages (DOT) to the piece workers of Ordnance Factories for the period between normal working hours (44¾) and 48 hrs. In a week and whenever the piece worker works on a holiday/Sundays.
28) Grant of 30 days EL to the Industrial Workers of Ordnance Factories who have opted leave under the Factories Act 1948.
29) Co-relation of piece work rates in the revised 6th CPC pay scales for the employees of Ordnance Factories w.e.f. 1/1/2006 without any illegal reduction in the Labour Estimates and employees like Examiner and others who are not governed under any incentive scheme may also be granted Incentive.
30) Grant of the pre-revised pay scale of Rs.1640-2900 to the PAs at par with other Central Government Departments with effect from 01.01.1986.
31) Grant of Four Grade Structure to the Fire Engine Drivers of Navy, DGOS and other Defence Establishments at par with Ordnance Factories and DGQA.
DRDO Specific issues
32) Scrap the adverse recommendations of the Professor Rama RaO Committee against
DRDO.
33) Immediate payment of 20% incentive to the DRDO employees without further delay.
34) Review of DRTC Scheme of DRDO and make it 100% flexible complementing scheme by incorporating the suggestions of the Federations.
35) Approval of all pending Cadre Review Proposals.

DGQA specific issues

36) Constitution of a combined Defence Quality Assurance Board as recommended by CAG.
37) Restore the indigenization responsibility to DGQA.
38) Review the rotational transfer policy as agreed by the Defence Secretary in the Departmental Council JCM Meeting.

MES Specific issues

39) Creation of Chargeman post at par with other Defence Establishment.
40) Fill up ADRP vacancies for the year 2006-07, 2007-08 and 2008-09.
41) Four grade structure for Meter Reader, Lift Operator and Upholsterer.
42) All qualified Diploma holders may be allowed for promotion to JE.
43) Grant of Skilled Pay Scale to the Valveman from the date, of recruitment as directed by the Hon’ble Supreme Court.

45) Four Grade structure for Armament Mechanic of NAD.
46) Reframing of all the Recruitment Rules arbitrarily framed by the NHQ by incorporating the amendments proposed by the Federations.

Consumer Price Index Numbers for Industrial Workers (CPI-IW) December 2012


The All-India CPI-IW for December, 2012 rose by 1 point and pegged at 219 (two hundred and nineteen). On 1-month percentage change, it increased by 0.46 per cent between .November and December compared with (–)1.01 per cent between the same two months a year ago.

The largest upward contribution to the change in current index came from Miscellaneous Group which increased by 1.08 per cent, contributing 0.49 percentage points to the total change. This was followed by Clothing, Bedding & Footwear and Fuel & Light groups with 1.17 and 0.92 percent respectively contributing 0.13 and 0.10 percentage points to the change. At item level , largest upward pressure came from Rice, Wheat Atta, Groundnut oil, Fish Fresh, Goat Meat, Poultry (Chicken), Onion, Tea (Leaf), Tea (readymade),Electricity charges, Firewood, Sweater, E.S.I. contribution, Medicine (Allopathic), Private Tution Fees, us fare, Flower/ Flower Garlands, Tailoring Charges, etc.

The largest downward contribution to the change in current index came from Vegetables & Fruits with a decline of (-) 8.33 per cent contributing (-) 1.21 percentage points to the total change.

The year-on-year inflation measured by monthly CPI-IW stood at 11.17 per cent for December, 2012 as compared to 9.55 per cent for the previous month and 6.49 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at 13.53 per cent against 10.85 per cent of the previous month and 1.97 per cent during the corresponding month of the previous year.

At centre level, Hubli Dharwar recorded the largest increase of 10 points followed by Quilon (8 points) and Mundalakkayam and Ernaculam (7 points each) and Mysore (5 points). Among others, 4 per cent rise was registered in 2 centres, 3 points in one centre, 2 points in 11 centres and one point in 12 centres. Doom Dooma Tinsukiya centre reported a decline of 5 points followed by Jalpaiguri and Faridabad 4 points each. Among others 6 centres registered a fall of 3 points, 11 centres registered a fall of 2 points and 13 centres registered a fall of 1 point. Rest of the 14 centres indices remained stationary.

The indices of 37 centres are above All-India Index and other 37 centres’ indices are below national average. The indices of Jabalpur, Bengaluru, Chandigarh and Haldiya remained at par with all-India index.

The next index of CPI-IW for the month of January, 2013 will be released on Thursday, February 28, 2013 and will be uploaded on the office website www.labourbureau.nic.in on the same day.

Subject: Nomination of Area Welfare Officers for the calendar years 2013 and 2014 for Delhi / New Delhi.

The undersigned is directed to say that the officers, whose particulars are shown in the enclosed list have been nominated as Area Welfare Officers (AWOs) for the Calendar years 2013 and 2014 for the Areas in Delhi / New Delhi indicated against their names, with the approval of Joint Secretary and Chief Welfare Officer, DOPT.

2. It is further stated that the tenure of the Area Welfare Officers mentioned in the list shall be up to 31-12-2014 or till his/her services are required by the Government or the officer resigns or retires from service, whichever is the earliest . The AWOs will be entitled to avail of the facilities as decided by the Government from time to time. A list of their functions is also enclosed in Annexure-l, along with the list of AWOs.

‘Merger of 50% of DA and DR with basic pay’ – Finance Ministry explained as a reply to a unstarred question in the Parliament on 14th December, 2012.

The below explanation was presented by the Minister of States for Finance Shri.Namo Narain Meena to the questions regarding merger of DA / DR with basic pay of Central Government employees and Pensioners in the Parliament on 14.12.2013…

Whether various Associations/ Organisations of Central Government employees demanded merger of 50 per cent Dearness Allowance into the basic pay of Central Government employees and pensioners and the recommendation of the Sixth Central Pay Commission in this regard and action taken by the Government thereto?

Yes, A number of representations have been received from Associations/Organizations of Central Government Employees/Pensioners and individuals demanding merger of 50% of Dearness AHowance/ Dearness Relief with basic pay/pension respectively. The demand has been considered by the Government and not agreed to since the 6th Central Pay Commission has not recommended as such.

The 6th Central Pay Commission did not recommend merger of dearness allowance with Basic Pay at any stage. Government accepted this recommendation vide Government of India Resolution dated 29.08.2008.

(Note : Merger 50% of Dearness Allowance with basic pay to the employees of Central Public Sector Enterprises (CPSEs) following 1997 Industrial Dearness Allowance (IDA) pattern of scales of pay with effect from 1.1.2007.)

Sub: Railway Services (Revised Pay) Rules, 2008 — The re-exercise of option under Rule 6 of the Railway Services (Revised Pay) Rules, 2008 in the case of employees covered under letter dated 23.03.2012.
As per provisions contained in Rules 5 & 6 of the Railway Services (Revised Pay) Rules, 2008, the railway employee had an option to elect to come over to the revised pay structure either from 01.01.2006 or from the date of his next increment or from the date of promotion, upgradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of Railway Services (Revised Pay) Rules, 2008. The rule also provides that the option once exercised shall be final.

2. This Ministry issued instructions vide letter of even No dated 23.03.2012 providing that those Railway employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 01.01:2006 in the pre-revised pay scale as a one time measure and, thereafter they will get the next increment in the Revised Pay structure on 01.7.2006 as per Rule 10 of the Railway Services (Revised Pay) Rules, 2008.

3 In view of the benefit extended to the employees as per the aforesaid letter dated 23.03.2012 the issue relating to according of a fresh opportunity to the employees to re-exercise their option to come over to the revised pay scale as per Revised Pay Rules, 2008 was raised by the Staff Side of the Joint Consultative Machinery in the meeting of the National Anomaly Committee held on 17.7.2012.

4. The matter has been considered by the Government and having regard to the fact that the provisions of the aforesaid letter dated 23,03.2012 bring about a material change n the basis for exercise of option to come over to the revised pay structure in terms of the Railway Services (Revised Pay) Rules, 2008 in respect of employees who are covered under the said letter dated 23.03.2012, the President is pleased to decide that all those employees who are covered under the provisions of aforesaid letter dated 23.03.2012 may once again be permitted to re-exercise their option to come over to the Revised Pay Structure.

5. The benefit under these orders for re-exercise of option shall be available for a period upto 31.03.2013. The revised option shall be intimated to the head of the office by the concerned employees in accordance with the provision of Rule 6(2) of Railway Services (Revised Pay) Rules, 2008.

6. All the Zonal Railways/Production Units etc. are requested to bring the content of this letter to the notice of their employees so that such employees can avail themselves of the same within the stipulated time period.

7. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

An important letter has been sent to Railway Board by the General Secretary of AIRF regarding the issue of arrears to be paid in difference of TA due to implementation of MACP to Railway employees.

Sub: Payment of difference in TA to the employees due to implementation of MACP Scheme

Consequent upon implementation of the orders, modifying ACP Scheme as MACP Scheme on the basis of recommendations of VI CPC, many employees were granted financial upgradation under MACP Scheme w.e.f 01.09.2008. T.A. amount was claimed by the employees as per their old grade pay prior to their financial upgradation, and they are due for the arrears of TA with retrospective effect due to implementation of MACP orders.

The matter was taken up by our affiliate, S.C. Railway Mazdoor Union, with South Central Railway Administration, requesting payment of supplementary claims relating to difference of TA on enhanced pay of the employees who have been granted benefit of financial upgradation under MACP Scheme with retrospective effect.

It is unfortunate, that the above request of our affiliate was not considered favourably by the Railway Administration, saying that the payment of different of TA consequent upon financial upgradation with retrospective effect is not in consonance with Board’s instructions/codal provisions.

There is a provision exists in the Note under para 1602(2) of the IREC, that, in the case of late authorization/ drawl of increments with retrospective effect, other than those where increments were withheld or where increments take an officer above the stage of efficiency bar, there is no objection to supplementary claims relating to Travelling Allowance, if any, being admitted, on the basis of enhanced pay, including increments.
In this connection, photocopy of letter No.P(R) 75/VII dated 25.01.2012 of the CPO/SCR is enclosed herewith.

In view of the above, the Board are requested to issue necessary orders to South Central Railway Administration for the payment of arrears of TA to the employees who were granted financial upgradation under MACP Scheme w.e.f. 01.09.2008.
