ANSWERS TO THE QUESTIONNAIRE OF 7TH CPC
 
1 SALARIES
1.1 The considerations on which the minimum salary in case of the lowest Group ‘C’ functionary and the maximum salary in case of a Secretary level officer may be determined and what should be the reasonable ratio between the two. 
  
Answer 1.1:- We are of the opinion that the consideration on which the minimum salary in case of lowest Group ‘C’ functionary should be based on the norms set by the 15th International Labour Conference (ILC) with certain amendments. Earlier Central Pay Commissions have kept in the mind that the minimum salary is applicable at the time a person joins the Government which will usually be at a young age when a person may be married and may not have responsibility of parents or many children and accordingly, the family unit for minimum salary can only be taken as three.
 
Contrary to this, Indian family is considered strong, stable, flexible and enduring and normally it consist of three to four living generations, including brothers, sisters, uncles, aunts, nieces, nephews and grandparents living together in the same home. The official statistics reveal that large segments of the elderly in India are illiterate, out of work force, partially or totally dependent on others and suffering from health problems or physical disabilities. Hence, a person when joins the Government he has to look after his parents, wife, children, brothers and grandparents also. The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 also compels him to take care of his/her parents.

Four-five years ago, the Dopt’s website was not regular in updating and releasing all the relevant Government Orders. But, things have changed now and, along with timely updates, the website has also become a very reliable forum to clear doubts.

We have made it a habit to publish the orders to the knowledge of all Central Government employees as soon as DOPT releases them.

DOPT is the coordinating agency that has the power to decide the fate of Central Government employees.

ORDER
 
CGHS has empanelled private hospitals and diagnostic centres in various CGHS covered cities to provide health care facilities to CGHS beneficiaries.

Empanelment of the private hospitals is done under a contractual agreement between the Government of India and the private hospitals and diagnostic centres on mutually agreed terms and conditions.

It was reported that your hospital has taken a unilateral decision of denying cashless/credit facilities to eligible CGHS beneficiaries, which is tantamount to violation of terms and conditions of MOA. Provision of treatment to pensioners and other eligible CGHS beneficiaries is one of the terms of essence, as denial of credit facility causes immense hardship to pensioners beneficiaries, who have to spend money from their meagre savings.
 
In this connection a Show Cause Notice was issued vide this office letter No.No.CGHS/JPR/12-58/2014(Admn.)/23567-68 dated 10.3.2014 giving an opportunity to your hospital to put forth your stand on the Issue.
 
The reply dated 12.3.2014 submitted by you in response to the Show Cause Notice has been examined. CGHS signed MOA with individual hospitals and not with any association and hence association has no locus stand in the matter. Hence, the reference is not relevant, Even if any hospital has some grievance and consider not viable for it to continue on the panel, it can withdraw from the list of empanelled hospitals, Government has taken several steps to clear the pending bills on priority basis and therefore, there is no major issue regarding pendency of hospital bills. It is felt that denying the treatment on cashless basis is a gross violation of terms and conditions of the MOA signed by your hospital for empanelment with CGHS.
 
Since, it is open for your hospital to withdraw from the panel and since denial of cashless facility to eligible beneficiaries is not acceptable from any hospital on the penal, it has been considered appropriate to suspend the CGHS empanelment of your hospital with immediate effect for a period of six months or till further orders, whichever may be earlier. The hospital shall no longer be a part of the list of CGHS empanelled hospitals / Diagnostic Centres for any purpose under CGHS. Patients already admitted prior to issue of this order shall however, be provided treatment at CGHS rates.

The Modified Assured Carrier Progression scheme (MACPS) came into effect in terms of RBE No.101/2009 dated 10/6/2009 modifying the ACP scheme already invogue before this scheme.  AIRF writes to Railway Board regarding discrepancies in implementation of MACP Scheme over Indian Railways:-

Ref. (i) Board's letter No.PC-V/2009/ACP/2 dated 10/6/2009(RBE No.101/2009) and dated 29/12/2011  (ii) Board's letter No. PC-V/2011/M/3/AIRF dated 25/2/2014



The Modified Assured Carrier Progression scheme (MACPS) came into effect in terms of RBE No.101/2009 dated 10/6/2009 modifying the ACP scheme already invogue before this scheme. The Railway Board's letter supra gives detailed provisions of MACPS as also clarifies a numbers of related issues. The illustration on page No. 9 of the said letter states at (a) under Para 28 that "in case an employee had earned first promotion within a period less than 10 years, say in 8 years of regular service and then continues in same grade pay for further 10 years, without any promotions, he will be entitled for 2nd financial upgardation under MACP on completion of 8+10=10 years and 3rd financial up gradation on completion of further 10 years service i.e. after 8+10+10=28 years."

Most of the Zonal Railways have implemented MACPS on the basis of above illustration in various categories of Railway staff. The Railway Board, however, while clarifying the matter vide their letter dated 29/12/2011 have stated that "1s, financial up gradation would be on completion of 10 years of continues service in same grade pay, 2nd on completion of 20 years service from the date of initial appointment or 10 years from the date of Is, financial upgradation/prornotion, whichever is earlier & 3rd financial up gradation would be admissible on completion of 30 years regular service of initial appointment or 10 years from the date of 2nd financial upgradation/promotion whichever is earlier." The illustration under Para 28 in the Board's letter dated 10/6/2009 has, however, been reiterated in the letter dated 29/12/2011 also. It is evident from the clarification that an employee would be eligible for 2nd & 3rd financial upgradation after completion of 10 & 20 years service from his/her first promotion.

However, the clarification further issued vide Board's letter under reference at S.No-2 is in contradiction to the above provisions so far as the concluding line of the said letter is concerned, which states that " It is not possible to agreed to grant of 3rd financial upgradation under MACPS on completion of 20 years of service after 1st promotion/ upgradation.

The Board are therefore, requested to further look into the matter in totality, as this would undo the provision already made vide Railway Board's letter dated 10/6/2009 & 29/12/2011,resulting in a lot of recoveries from the staff in case of whom the MACPS has been implemented in terms of Railway Board's letter under reference at S.No-1. This issue may be discussed with AIRF threadbare, so that there is no contradiction creating confusion in implementation of MACPS prevailed over Indian Railways and recoveries, if any being initiated on this account in any Zonal Railway, may be stopped till finalization of this issue.

This may kindly be treated as urgent.

List of Allowances & Advances increased by 25% due to DA touched to 100% with effect from 1.1.2014. 
List of all allowances and advances enhanced by 25% from the existing level from 1st January 2014 in order to enter the Dearness allowance into 100%. Already in January 2011, followed the 6th CPC recommendations, all the allowances and advances had been enhanced by 25% due to Dearness allowance crossed 50% mark. This is second time to get the allowances at revised rates.

Subject: Enhancement of Constant Attendance Allowance in respect of Disabled Armed Forces Personnel.
Reference: Circular No. 410, Circular No. 411 & Circular No. 472.
 
In terms of Para-8 of GOI, MOD letter No. 16(6)/2008(2)/2008/D (Pension/ Policy) dated 05th May’ 2009 and Para-3 of GOI, MOD letter No. 16(6)/2008(1)/2008/D (Pension/ Policy) dated 04th May’ 2009 “Constant Attendance Allowance shall continue to be admissible under the conditions as hitherto fore. However, it shall be admissible at a uniform rate of i 3000/- PM irrespective of the rank. Further, this rate be increased by 25% every time the dearness allowance payable on revised pay band goes up by 50%.” As per GOI, Ministry of Finance, New Delhi letter No. 1/1/2014-E-I1 (B) dated 27th March’ 2014 the rates of Dearness Allowance has been revised @ of 100%.
 
2. Therefore, the rates of Constant Attendance Allowance will be again increased by 25% wef 01st January’ 2014 and accordingly the CAA will be payable @  4500/- PM wef 01st January’ 2014. 
 
3. It is therefore requested that the payment of Constant Attendance Allowance (CAA) may please be regulated accordingly.
